MACC officer apologises as defence seeks contempt action in Jana Wibawa trial

KUALA LUMPUR: The defence team today applied to the High Court here for a Malaysian Anti-Corruption Commission (MACC) investigating officer in the trial of the Jana Wibawa programme to be held in contempt of court over the commission's action in lodging a police report.

The report was lodged for police to investigate how businessman Adam Radlan Adam Muhammad's statement recording in a separate case came into the defence team's possession, despite the document allegedly being unrelated to former prime minister Tan Sri Muhyiddin Yassin's case.

Lawyer Datuk Amer Hamzah Arshad, who is representing Muhyiddin, told the court that the report, which was subsequently reported by the media, was seen as an attempt to tarnish his image as one of the lawyers representing the former prime minister.

He applied for contempt of court proceedings to be initiated against the 29th prosecution witness, Mazery Mohd Zaini, for allegedly breaching the court's directive not to discuss details of the trial outside the proceedings.

The court was scheduled to hear Mazery's evidence during re-examination today before the defence team raised an objection over the police report lodged by MACC.

Amer Hamzah said the witness's action in lodging a police report over a document submitted by the defence could be considered contempt of court, in addition to alleging that the witness had previously been ordered by the court not to communicate with any party while still giving evidence.

"The report that they lodged against me and naming me personally is a declaration of war," Amer said during his submission in court.

He said the witness should also not have stated that the document was unrelated to the trial as he was still in the process of giving evidence.

"There are lines that we do not cross," he said.

Amer Hamzah said that he was not intimidated by the action taken against him over the police report and was prepared to face any consequences in carrying out his duty to defend his client.

"They drew first blood, and I will repay them with no quarters," he said.

Following the submission, Mazery, who is currently the head of Investigation Branch B of the MACC investigation division, immediately apologised to the defence lawyers, particularly Amer Hamzah, over the police report lodged concerning the leak of a document containing a copy of a recorded conversation involving former Segambut Bersatu division deputy chief Adam Radlan, who has been repeatedly mentioned during the trial.

"First, I would like to apologise to the defence lawyers, especially Datuk Amer, over the issue of the (police) report that was lodged," he said.

He said the police report was lodged out of concern that the document might have originated from MACC officers and that there could have been an internal information leak.

"I was worried that there was an internal information leak involving MACC officers. So, I needed to protect my department and the integrity of MACC officers," he said.

Amer Hamzah then said he took note of the witness's apology and explanation but still could not fully accept the reason as long as the police report remained.

"Every single second counts. Every single second that the report remains out there is a second more that my reputation has been tarnished unnecessarily and maliciously," he said.
